What's Next with
PC 0002 - The Proposed Tax Swap Constitutional Amendment? --
Now that the
Florida Taxation and Budget Reform Commission has concluded
its work, some of you are wondering about the process that
follows.
The Commission adopted seven
proposed constitutional amendments which have been sent to the
Secretary of State. Legislative approval of the proposed
amendments is not needed. Unless an organization
or group of organizations successfully files a legal
challenge, the proposed amendments will appear on the November
2008 ballot.
Depending on how the amendments are classified, either
a 60 or 66% approval vote will be required for passage. (Any
constitutional amendment that results in higher taxes requires
a 66% approval rate.)
The now infamous
CP 0002 will be amendment 5 on the November ballot. It has been dubbed the
Tax Swap amendment by the press and business community. Amendment 5 would
reduce the maximum annual change in assessments for
non-homestead properties to 5% from 10% effective January 1,
2009. It also
would reduce the authorized ad valorem millage for school
purposes from 5 mills to 10 mills effective January 1,
2010. If the
amendment passes in November, the 2009 Legislature would be
required to replace the revenue lost as a result of the tax
relief with: (1) a repeal of sales tax exemptions that do not
advance or serve a public purpose, (2) an increase of up to
one percentage point in the State sales tax, and (3) other
revenues identified or created by the Legislature. The tax relief
provided by amendment 5 will result in the loss of
approximately $9.8 billion in revenues (possible as much as
$12 billion) that would have to be replaced with monies raised
in part from the repeal of current sales tax exemptions and
exclusions and other initiatives.
Constitutional
amendment 5 creates an exemption from the repeal of sales tax
exemptions for: food; prescription drugs; health services;
charitable organizations; religious organizations; residential
rent, electricity and heating fuels; sales of tangible
personal property purchased for resale or import, produced or
manufactured in the State for export; sales of real property;
and sales of intangible personal property. The language was
amended for FAHSA to separate charitable and religious so that
an entity does not have to be both charitable and religious to
qualify for the exemption. This was a
very important and noteworthy victory.
Unfortunately, the commission rejected our suggestion to
define "heath care" and " charitable." Therefore, if the
amendment passes, the Legislature and Department of Revenue
must take on the task.
Depending on the definitions, it is possible that some
of the exemptions nonprofit organizations, and "homes for the
aged" and their residents now receive will be in jeopardy.
FAHSA and our
members will have an opportunity during the 2009 Legislative
Session, and the months leading up to it, to make a case that
our exemptions do in fact serve a public purpose. We will need
your help in making that case and educating lawmakers and
candidates for the Legislature about the value of nonprofit
organizations and "homes for the aged." The task will be
complicated by the fact that many of our friends in the
Legislature will not be returning in 2009 because of term
limits.

| FAHSA's Innovation Exchange Corner

"Activities on
Wheels"-- FAHSA's Innovation Exchange Program
provides members with an
opportunity to share ideas and best practices with others and
to recognize their staff for extraordinary performance.
Through the LINK, we hope to encourage more members to share
what they do best and to increase awareness about the
Innovation Exchange Web site, an important but little known
resource. This month, we are showcasing "Activities on
Wheels", which adds a new spin on activities programs. This program was
submitted by Sunnyside Nursing Home in Sarasota.
"Activities
on Wheels" features a variety of activities placed on two
rolling carts. The rolling carts travel throughout the nursing
home and visit resident's rooms several times per day. This allows the
activities staff to interact with the residents who choose to
stay in their rooms.
This also works well for residents who don't have the
energy to participate in group activities after an intensive
day of therapy.
Some of the activities on the carts include: CD players
with a variety of music choices, books on tape, crossword
puzzles, trivia sheets, word search puzzles, mini jigsaw
puzzles, magazines of all types and large print books. There are decks of
cards, dominoes, and checkers for residents who wish to play
board games, and water color painting for the artistic
minded. The cart
also contains snacks like granola bars, cereal fruit bars,
chocolate bars and cheese and crackers, for those who would
like a small snack.

deficiencies were the most common citations for assisted
living facilities (ALFs) from July 1, 2006 through June 30,
2007. Please share with your staff so they can check for
problems in these areas when doing mock surveys or a risk
management review.

Wal-Mart Expands
Drug Discounts
- According to as recent article in the Miami Herald,
Wal-Mart
announced that it was expanding its four dollar
prescription-drug program to include more than 1,000
over-the-counter drugs and adding 90-day prescriptions for
$10. Target stores immediately said it would match all
aspects of the program.

New
Aging in Place Reports Released --
Two reports, one from AARP and the other from the Center for
Aging Service Technologies (CAST) of the American Association
of Homes and Services for the Aging, concluded that seniors
want to use technology to age safely in place. The studies
also found that caregivers believe some challenges can be
eased through technology. The reports also found that both
seniors and caregivers raised concerns that factors associated
with the technology such as installation and maintenance costs
act as barriers to the use of these new products. "Our study
shows that we can create a network of technology-driven
services to help elders stay at home and achieve better
outcomes," said Majd Alwan, Ph.D., Director, CAST. To find out

CMS Posts
"Refinement of Medicare's Home Health Prospective Payment
System- Final Report" -- Recently, CMS
posted the Abt Associates Technical report titled, "Refinement
of Medicare's Home Health Prospective Payment System: Final
Report," describing results of research and analysis conducted
to address Medicare's information and program administration
needs pertaining to the home health prospective payment system
(HH PPS) that was implemented in October 2000. The report
provides details on the data analysis and simulations used by
CMS in the development of the May 4, 2007 Notice of Proposed
Rulemaking (CMS-1451-P) and the August 29, 2007 Final Rule w/
Comment (CMS-1541-FC) for the Home Health Prospective Payment
System Refinement and Rate Update for Calendar Year 2008.

Temporary
Interruption in Service -- There will be
a temporary interruption in the service of the Enterprise
Income Verification (EIV) Multifamily Help Desk until
approximately May 16, 2008, due to contractual issues.
EIV apologizes for this inconvenience and requests that all
contact with the Multifamily Help Desk be by e-mail to Mf_EIV@hud.gov. Once the
contractual issues have been resolved, the Multifamily Help
Desk will respond to the e-mails in the order in which they
were received.
Affordable Housing Study Commission to
Resume - The Affordable Housing Study Commission
(AHSC) will resume in 2008 for its quarterly meetings
beginning on June 19th, 2008 when they will
select and discuss which study topic(s) to choose for the
2008-2009 study year. If you have any suggestions for a
new study topic or to serve on the AHSC board of directors,

HUD Issues Memo Indicating
Economic Stimulus Checks Will Not Impact Income
Calculations -- HUD
has issued a new memo noting that the economic stimulus
payments authorized by Congress in February 2008 should not be
used for income calculations determining tenant eligibility
and rents.

Elevator
Safety Bill Extending Timeframes Did Not Pass --
Substantial
legislation that would have been beneficial for some FAHSA
members extending the deadlines for an alternative power
source in place to operate an elevator during a power outage
in residential multifamily dwellings and for verification of
compliance with installation and operational capability
requirements did not pass during session. The bill, HB 253/SB
550, sponsored by Rep. Frishe / Sen. Jones would have extended
those deadlines by at least two years. The House passed their
version of the bill, sent it to the Senate, but it died in
messages.
Please make sure
that you are in compliance with legislation in s. 553.509
that passed in 2006 and that your disaster plan includes the
following information:
-
Multistory
affordable residential dwellings for persons age 62 and
older that are financed or insured by the United States
Department of Housing and Urban Development must make every
effort to obtain grant funding from the Federal Government
or the Florida Housing Finance Corporation (FHFC) to comply
with this subsection. FAHSA requested a letter
from Steve Auger, Executive Director with Florida Housing
Finance Corporation stating that grant funds for generators
are not available at this time. The letter is
posted on the FAHSA website for your records.

If an owner of a
residential dwelling cannot comply with the requirements of
this subsection, the owner must develop a plan with the
local emergency management agency to ensure that residents
are evacuated to a place of safety in the event of a power
outage resulting from a natural or manmade disaster or other
emergency situation that disrupts the normal supply of
electricity for an extended period of time. A place of
safety may include, but is not limited to, relocation to an
alternative site within the building or evacuation to a
local
shelter. |

Proposed Rule Would Cut
Medicare Payments to Skilled Nursing Facilities (From AAHSA)
-- A technical
"recalibration" of Medicare rates just proposed by the Centers
for Medicare and Medicaid Services (CMS) would cut payments to
skilled nursing facilities by $770 million, or 3.3 percent, in
fiscal year 2009. CMS claims that nursing facilities would see
only a net 0.3 percent cut in payments because of the annual
market basket update the agency has recommended for next year.
However, President Bush's budget called for the market basket
update to be withheld for next year and Medicare legislation
which Congress must pass this year could affect the update. We
strongly oppose any reduction in Medicare payment rates and we
are making our objections known to both CMS and Congress. We
will issue a special report later this week with more
information and steps you can take to prevent this cut. For
